It governs Personal Information we collect through our website(s), microsite(s), mobile website(s), and mobile applications (collectively, "Sites") and Personal Information we collect from you or third parties through any other means to provide our services or perform other business activities (collectively, "Services").

This Privacy Policy is part of our Terms of Use for our Sites. Please carefully read this Privacy Policy before using our Sites or Services. By accessing or using our Sites or Services, you agree to our use of your information consistent with the Terms of Use and this Policy.

If you are a California resident and provided information to us as an employee, job applicant, or contractor, or otherwise in connection with potential employment or engagement, or you are a dependent, emergency contact, or beneficiary of such a person, the Privacy Practices Related to California Employees and Job Applicants section below describes our privacy practices with respect to such information.

2. Privacy Policy Changes

This Privacy Policy is subject to change. We encourage you to review it frequently for any revisions or amendments. Unless otherwise stated, changes will be effective immediately upon posting. You will be deemed to have been made aware of and have accepted the changes by your continued use of our Sites or Services. If we determine that a change to this Policy will result in using your Personal Information acquired before the change in a materially new way, we will provide you notice before using your Personal Information in the new way.

3. Conflict Between This Policy and Laws and Regulations

When federal, state, or local laws or regulations require a higher level of protection for your Personal Information, they take precedence over this Privacy Policy. Otherwise, the specific requirements of this Policy apply.

4. Information We Collect

Personal Information

We may collect information that personally identifies, relates to, describes, or is capable of being associated with you ("Personal Information"), including:

• Identifiers: such as name, mailing address, service address, email address, phone number, fax number, and Grit Marketing account login credentials.
• Characteristics of protected classifications: under California or federal law, such as age, marital status, gender, ethnicity, and country of origin.
• Other demographic information: such as the number and ages of children, language(s) you speak, whether you own or rent a property, household size, and household income.
• Commercial information: such as bank account number, payment card information, service type(s), service dates, customer type, account balance and status, and information related to financing of properties that you own or that we service.
• Internet or other electronic network activity information: such as browsing or search history, IP address, cookie and similar-technology data, device IDs, specifications, and operating system.
• Geolocation data: such as precise geolocation data only as described below and non-precise geographic indicators from mobile devices, websites, and service addresses.
• Audio, electronic, visual, thermal, olfactory, or similar information: such as call recordings, chat transcripts, and pictures or images of your properties.
• Professional or employment information: such as employer and occupation.
• Education information: such as education level.
• Inferences: drawn from other Personal Information that relate to preferences, interests, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
• Personal Information described in Cal. Civ. Code § 1798.80(e): to the extent collected under another category above.

Some of the Personal Information listed above may be considered Sensitive Personal Information under relevant privacy laws. This includes Grit Marketing account login credentials, ethnicity, country of origin, and precise geolocation data. Each type of Sensitive Personal Information may overlap with a category of Personal Information listed above. The types of Personal Information we collect about you may vary based on how you use our Sites or Services and your relationship with us.

Usage Data and Site Activity

We automatically collect information in connection with the actions you take on our Sites ("Usage Data"). For example, each time you use our Sites, we automatically collect the type of web browser and device you use, your operating system and version, Internet Service Provider, IP address, pages viewed, referring and exit pages, date and time of your visit, clicks to, from, and within our Sites, and the duration of your visits. If we can reasonably associate this information with you, directly or indirectly, we treat it as Personal Information under the categories of Identifiers or Internet or other electronic network information, as appropriate. If we cannot reasonably associate it with you, we treat it as anonymous Usage Data.

Communication Recordings

We may record calls and retain the content of text messages, chat transcripts, emails, and other written or electronic communications between you and us. By communicating with us, you consent to our recording and retention of communications where permitted by law.

De-Identified Information

We may de-identify or anonymize Personal Information so that it is no longer capable of being associated with you and therefore is no longer Personal Information. We may use and disclose de-identified or anonymized information without restriction. We will not attempt to re-identify previously de-identified or anonymized information.

5. How We Collect Information

From You

We may ask you to provide Personal Information when you communicate with us online or offline, including through events, surveys, and marketing or promotional programs. You are not required to provide it; however, if you choose not to provide requested information, you may not be able to use some features of the Sites or Services or we may not be able to fulfill your requested interaction. We may also capture Personal Information when you contact us by phone, email, or other means.

Third-Party Data Sources

We may collect Personal Information from third-party data sources such as data brokers, consumer reporting agencies, marketing agencies and partners, analytics firms, other consumers, and government agencies.

No Sale of Personal Information

We do not sell, rent, or lease your Personal Information to third parties for monetary consideration. We may share your Personal Information only in the ways described in this Privacy Policy and as permitted by applicable law.

Interest-Based Advertising

We may work with third-party advertisers, search providers, and ad networks ("Advertisers") to learn more about you and show ads or other content that we believe would be relevant to you. Advertisers may collect and use information about your use of our Sites or Services as well as other websites and services. We and/or Advertisers may append other data to information collected by Advertisers to create an interest profile of individual users. This Policy does not cover an Advertiser's use of information it collects from you. Advertisements may be shown through our Sites or on third-party websites.

Service Providers and Business Partners

We may disclose Personal Information to vendors that support our business, including cloud hosting and content-management providers, communications providers, applicant-tracking providers, analytics providers, and advertising platforms. The Sites currently use or may use providers in these categories, including Breezy HR for job applications, Resend for email delivery, Google Analytics and PostHog for analytics, and Meta technologies for advertising measurement. We disclose information to these providers only as needed for their services or as otherwise permitted by law.

Legal, Safety, and Corporate Disclosures

We may disclose Personal Information when we believe disclosure is necessary to comply with law, regulation, legal process, or governmental request; enforce our agreements; protect the rights, property, safety, or security of Grit Marketing, our users, or others; or investigate and prevent fraud or other illegal activity. We may also disclose information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or other corporate transaction, subject to applicable law.

These choices may not affect operational, transactional, or other non-promotional communications.

11. Privacy Practices Related to California Employees and Job Applicants

This section applies to California residents whose Personal Information we process in an employment, job-application, contractor, dependent, emergency-contact, or beneficiary context. We may collect and use that information to evaluate applications and qualifications, administer employment and benefits, manage workforce and business operations, comply with law, maintain security, and protect Grit Marketing and its personnel. Information collected in this context is subject to the rights and exceptions available under applicable law and may be shared with service providers, benefits providers, professional advisers, government agencies, and other parties as needed for those purposes.

12. Children’s Privacy

Our Sites and Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If you believe a child has provided us Personal Information, please contact us so that we can take appropriate action. If we knowingly collect Personal Information from a child where parental consent is required, we will obtain that consent or delete the information as required by law.

14. The Grit Mobile Application

This section applies specifically to The Grit mobile application (“App”) and supplements the rest of this Policy.

Grit Companies, LLC, an affiliate of Grit Marketing, LLC, operates the App. The App supports The Grit’s internal recruiting operations in the United States and is available only to authorized employees, independent contractor representatives, and administrators.

Information Collected

Depending on how the App is used, Grit may collect or process:

• Names, contact information, addresses, and dates of birth
• Account identifiers, roles, permissions, and organizational relationships
• Optional profile pictures
• Recruiting, experience, referral, leadership, onboarding, and commission information
• Recruiting notes, meetings, reviews, and administrative activity
• Security, audit, support, crash, and diagnostic information

Authorized users may also provide information about recruits and representatives who do not personally use the App.

How Information Is Used

Grit may use App information to:

• Authenticate users and manage access
• Operate recruiting and onboarding workflows
• Maintain recruit and representative records
• Manage organizational and reporting relationships
• Support commission review and internal reporting
• Protect the App and maintain audit history
• Diagnose errors and provide support
• Comply with legal obligations
• Establish, exercise, or defend legal claims

Authorized Grit administrators, managers, and representatives may access information according to their roles, permissions, and reporting relationships.
